Our Disclosures
Before becoming a customer, please note the following important points:
- Order Cancellation: We may cancel an accepted order at any time before delivery for any reason. If we do, we will refund you using the original payment method.
- No Change of Mind Refunds: We do not offer refunds for change of mind.
- Cancellation Fees: If you cancel an order after it has been placed but before it has been shipped, we may charge a restocking and administrative fee.
- Liability Limitation: Our liability under these terms is limited to the purchase price of the products related to the claim, and we are not liable for consequential loss.
- Third-Party Benefits: We may receive a benefit, such as a referral fee or commission, if you visit certain third-party websites via links on our Site or if we feature certain products or services.
These terms do not limit your rights under Australian Consumer Law.
1. Introduction
(a) Definitions: "You" refers to you and any entity you represent. "We" or "us" refers to Grill King Outdoor BBQ Kitchens (ACN 663 304 184).
(b) Purchases: You can make purchases at our Australian premises or on our website: Grill King Outdoor BBQ Kitchens.
2. Use of the Site
(a) Acceptance of Terms: You accept these Terms by either:
- Signing and returning these Terms, making a purchase in Store, and paying the Price; or
- Placing an order on the Site.
(b) Age Requirement: You must be at least 18 years old to use the Site or place an order.
(c) Prohibited Activities: You must not engage in unlawful or inappropriate activities on the Site, including:
- Breaching privacy or legal rights;
- Defaming, harassing, threatening, or offending any person;
- Using the Site for unlawful purposes or interfering with other users;
- Tampering with the Site or using data mining tools.
3. Accounts
(a) Account Creation: You can purchase products with or without an account. An account allows you to review your order history.
(b) Accuracy of Information: Ensure your personal information is accurate and up-to-date. We will handle all personal information according to our Privacy Policy.
(c) Account Responsibility: Keep your account details confidential. You are responsible for all activity on your account.
4. Orders
(a) Placing Orders: You may order products through the Site or in Store.
(b) Order Acceptance: We may accept or reject an order at our discretion. A binding agreement is formed once we accept an order.
(c) Order Details: Check all details, including products, delivery, and pricing, before submitting your order.
(d) Order Confirmation: After payment validation, we will send an order confirmation email.
(e) Age Restriction: Some products may not be suitable for children under 18 years old.
(f) Product Availability: All purchases are subject to availability. We strive to keep products in stock and the Site updated.
(g) Order Cancellation: We may cancel orders before delivery for reasons such as delays or errors. We will notify you if this occurs.
(h) Cancellation Fees: If you cancel an order before shipping, we may charge an administrative fee and a restocking fee:
- $1,000 if the order value is over $1,000;
- 20% of the total value for orders under $1,000.
5. Pre-Orders and Customised Goods
(a) Bulky and Pre-Order Items: Bulky items or pre-orders will be indicated. Delivery may take up to 4-12 weeks. BBQs have a lead time of at least 4-6 weeks.
(b) Customised Items: Customised items are non-refundable and may be delivered in parts over 4-12 weeks.
(c) Delivery Dates: Delivery dates are approximate and not guaranteed.
6. Price and Payments
(a) Payment: The purchase price plus applicable delivery costs must be paid upfront in Australian dollars, with GST set out separately.
(b) Payment Methods: Use the methods specified on the Site or in Store. Ensure you are authorized to use the payment method.
(c) Fraudulent Payments: Payments must not be made using fraudulent means.
(d) Third-Party Payments: Payments through third-party providers are subject to additional terms and conditions.
(e) Promotions: Use promotional discount codes at checkout. Conditions of use will be specified on the Site.
(f) Price Match Plus: We will match a lower advertised price from a local retailer and provide an additional 10% discount, excluding trade quotes, liquidation sales, and online platforms like Amazon and eBay.
7. Product Variances
(a) Product Characteristics: Products may differ from samples or images, including variations in color, texture, and design.
(b) Design Changes: We may make non-material changes to products as necessary.
8. Delivery, Title, and Risk
(a) Delivery Options: Choose between delivery or collection. We will provide an estimated delivery date and quote.
(b) Delivery Areas: We deliver to specified areas. Contact us if you are outside our delivery area.
(c) Delivery Restrictions: Delivery may not be available in some locations. We will notify you if this is the case.
(d) Delivery Changes: Notify us immediately if you need to change the delivery date or address.
(e) Delivery Methods: Delivery methods vary, and some may require a signature. If no one is available to accept delivery, we may leave the products at your premises.
(f) Shipping Costs: Shipping costs are outlined on the Site or in Store. Bulky items may not qualify for free shipping.
(g) Deferring Delivery: You cannot defer the delivery date without our written consent.
(h) Unaccepted Deliveries: If you do not accept delivery within 14 days, you may need to arrange your own delivery or storage, and storage fees may apply.
(i) Depot Pick-Up: If using the Depot Pick-Up option, stock availability and shipping costs are subject to change. We may cancel orders due to stock issues or high shipping costs and provide a full refund.
(j) Inspection: Inspect products upon receipt and notify us of any damage as soon as possible.
9. Collection
(a) Collection Location: Collect orders from our warehouse or as agreed.
(b) Collection Scheduling: Agree on a collection time and date. Notify us if you need to change it.
(c) Pick-Up Dockets: Present pick-up dockets. You may authorize someone else to pick up your goods with written authorization.
(d) Title Transfer: Title remains with us until full payment is made. Do not create any encumbrances on the products until title passes.
(e) Loading Responsibility: You are responsible for moving and loading products. Our personnel are not authorized to assist.
(f) Storage Fees: If you do not collect your order as agreed, storage fees may apply.
10. Storage
(a) Free Storage: We offer free storage for up to two weeks if you notify us at least 48 hours before the delivery date.
(b) Additional Storage: Additional storage may be available upon request, and we will provide a quote.
11. Removal Assistance
(a) Existing Equipment Removal: Notify us before the delivery date if you require removal assistance. We will provide a quote.
12. Assembly
(a) Paramount Delivery: Products will be assembled at delivery if you purchase the Paramount Delivery option. This is available in selected metropolitan areas.
(b) Express Delivery: Products will not be assembled with Express Delivery. Purchase the Paramount Delivery service separately if assembly is needed.
13. Australian Consumer Law
(a) Consumer Rights: You may have rights under Australian Consumer Law for repairs, replacements, or refunds.
(b) Exclusions: Terms do not modify or exclude rights under Australian Consumer Law.
(c) Return Costs: You cover return delivery costs for Consumer Law claims. We will refund these costs if the claim is valid.
(d) Refund Deductions: Refunds may be subject to Administrative or Restocking Fees.

14. Limitations
(a) Consequential Loss: Neither party is liable for consequential loss.
(b) Liability Reduction: Each party's liability is reduced proportionately based on the acts or omissions of the other party.
(c) Liability Limit: Our aggregate liability is limited to the purchase price of the products related to the claim.
(d) Information and Advice: Information on the Site is for general purposes only and does not substitute for professional advice.
15. Intellectual Property
(a) Ownership: Intellectual property developed by us remains our property.
(b) Usage Rights: You may use our intellectual property for personal, non-commercial use only.
(c) Prohibitions: Do not use our intellectual property for commercial purposes or without our written consent.
(d) Social Media: You may post our intellectual property on social media under specific conditions.
16. General
(a) Dispute Resolution: Seek to resolve disputes through mediation before court proceedings.
(b) Notices: All notices must be in writing and sent to the addresses provided.
(c) Force Majeure: We are not liable for failures or delays due to circumstances beyond our control.
(d) Severability: If any term is unenforceable, the remaining terms will still apply.
(e) Governing Law: These Terms are governed by the laws of New South Wales, Australia.
(f) Entire Agreement: These Terms constitute the entire agreement between you and us regarding the sale of products.
(g) Amendments: We may update these Terms at any time. Check the Site regularly for updates.
(h) Waiver: No waiver of any term will be deemed a waiver of any other term.
(i) Assignment: We may assign or transfer our rights and obligations under these Terms.
